Terms governing your use of www.kaadxpay.com. Commercial terms for payment services live in the Master Service Agreement signed at merchant onboarding and are not replaced by this document.
Notice — pre-licensure v1.0
This is the v1.0 pre-licensure release of this document. It reflects Kaadxpay's currently implemented operating practice. Final text will be reviewed and signed off by our legal counsel after LFSA issues the final PSO licence and the new effective date will be posted here. For questions on any clause, or to request a formal copy ahead of finalisation, please use the email below — we respond within one business day.
01Acceptance of these Terms
These Terms of Service ("Terms") govern your use of www.kaadxpay.com and any subdomains we operate from time to time (collectively, the "Site"), provided by Kaadxpay Financial Solutions Pty. Ltd. ("Kaadxpay", "we", "us"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms cover the public marketing site only. Use of our payment APIs, merchant portal or developer console is governed by the separate Master Service Agreement and Developer Terms that you accept on registration with those services.
02Pre-licensure status & nature of the Site
Information about products, coverage, pricing or capabilities on the Site reflects our current operating plan; specific commercial terms are set out in signed agreements only.
03Eligibility
The Site is intended for business audiences (merchants, partners, regulators, employees, candidates, journalists). To use the Site you must be at least 18 years old and authorised to act on behalf of any business you represent in form submissions.
We do not knowingly accept enquiries from individuals or entities resident in jurisdictions on the FATF list of high-risk countries, on UN, EU or OFAC sanctions lists, or otherwise restricted by Malaysia AML/CFT law. Submissions originating from such jurisdictions will be reviewed and may be declined.
04Permitted use & restrictions
You may access and use the Site for lawful business purposes including evaluating Kaadxpay as a service provider, applying as a merchant or channel partner, reviewing regulatory disclosures, applying for a role with us, or reading published content.
You may not, directly or via automated means:
- Scrape, mass-download or mirror the Site, except for sitemap-based search-engine indexation.
- Submit false, misleading, fraudulent or honeypot-violating data via any form.
- Probe, test or attempt to bypass security controls (rate limits, content security policy, CSRF tokens, etc.) on the Site.
- Use the Site or any extracted content to develop a competing payment service, train large language models, or sell data to third parties.
- Frame, embed or republish the Site's content without prior written consent, except for short fair-dealing quotations with attribution.
- Use the Site in a way that violates applicable laws, including AML/CFT, sanctions and consumer-protection regimes.
We use rate-limiting, anti-bot honeypot fields, IP reputation checks and content-security-policy enforcement on every form endpoint. Abuse is logged and may be reported to the relevant network operator or law-enforcement authority.
05Intellectual property
All content on the Site — including the "Kaadxpay" word mark and logo, page copy, code samples, illustrations, diagrams, country guides and Insights articles — is owned by Kaadxpay or its licensors and protected by Malaysian and international copyright, trademark, patent and trade-secret law.
You may quote up to 200 words of textual content with prominent attribution to "Kaadxpay (www.kaadxpay.com)" for legitimate journalistic or academic purposes. All other use requires prior written consent from press@kaadxpay.com.
Code samples in our Insights and developer pages are released under the MIT License unless explicitly stated otherwise.
06Third-party content & links
The Site contains links to third-party resources (LFSA, FATF, partners, news outlets). We do not control, endorse or assume any responsibility for third-party content. Following such links is at your own risk.
07No warranty
The Site is provided "as is" and "as available". To the maximum extent permitted by Malaysian law, Kaadxpay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or that information presented is exhaustive. Specific commercial terms are set in signed agreements; nothing on the Site is a substitute for a signed contract.
08Limitation of liability
To the maximum extent permitted by law, Kaadxpay's total liability arising out of or in connection with your use of the Site, on any basis (contract, tort, equity, statute, or otherwise), shall not exceed the greater of (a) Malaysian Ringgit equivalent of USD 100 or (b) the amount you have paid Kaadxpay (if any) in the 12 months preceding the event giving rise to liability.
Kaadxpay is not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of business or loss of data, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.
09Indemnity
You agree to defend, indemnify and hold Kaadxpay (and its officers, directors, employees and contractors) harmless from any claim, demand, loss, damage or cost (including reasonable legal fees) arising out of or related to your breach of these Terms, your unauthorised use of the Site, or your violation of applicable law.
10Termination
We may suspend or restrict your access to the Site at any time, with or without notice, if we reasonably believe you are in breach of these Terms or applicable law. The provisions on intellectual property, no warranty, limitation of liability, indemnity and governing law survive termination.
11Governing law & dispute resolution
These Terms are governed by the laws of Malaysia (Federal Territory of Labuan). Any dispute, controversy or claim arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Asian International Arbitration Centre (AIAC) under the AIAC Arbitration Rules. The seat of arbitration shall be Kuala Lumpur. The tribunal shall consist of one arbitrator. The language of the arbitration shall be English.
Nothing in this section prevents Kaadxpay from seeking interim or injunctive relief from a court of competent jurisdiction to protect its intellectual property or confidential information.
12General
- Severability — if any provision is held unenforceable, the remainder of the Terms shall continue in full force.
- No waiver — failure by Kaadxpay to enforce any provision is not a waiver.
- Assignment — you may not assign these Terms; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Entire agreement — these Terms together with the Privacy Policy, Cookie Policy and (if applicable) any signed agreement constitute the entire agreement between you and Kaadxpay regarding the Site.
- Updates — we may amend these Terms; material changes will be notified via a banner on this page for at least 30 days.
